Samia's Driving School Terms and Conditions

These Terms and Conditions are an important part of your driving tuition.

I, Samia Rashid, am the proprietor and representative of Samia's Driving School.

Be fit to drive
Prescribed drugs that will affect your driving. You must hold a current and valid driving licence which must be produced on your first driving lesson, and at regular intervals throughout your training. Any changes to your driving licence due to medical conditions or driving convictions must be communicated to me immediately. Please ensure that you present yourself in suitable clothing, particularly practical footwear. It is also important to attend lessons with any appropriate glasses or contact lenses for reasons of road safety. If I think you are unfit to drive for failing to meet any of these conditions, the lesson will be cancelled at your expense. I cannot accept responsibility for any injury, loss or damage arising from a driving lesson.

Lesson payments
must be made at the beginning of each lesson, and can be paid by cash or card. The price for each lesson is £33.00/hour for manual lessons and £35/hour for automatic lessons. Student discount available for all students after providing their student identification the price is £30.00/hour for manual and £33/hour for automatic lessons.
Block bookings must be paid for in full on the first lesson of that block. There will NOT be any discounts below the block booking of 10 lessons. *Block booking prices are only valid if paid for in advance and must be redeemed within six months of the purchase date. Pupils paying for block booking tuitions must use the 10 lessons in a period of 6 weeks. Any lessons remaining will become void

If you suspend taking any pre-paid tuition for a period of 12 weeks or more, any remaining tuition owed will be forfeited.

Cancellation
48 hours (2 days) notice is required to cancel any driving lesson. If less than 48 hours (2 days) notice is given, half the lesson fee must be paid. If less than 24 hours (1 day) notice is given, the full lesson fee must be paid. If you suspend taking your driving lessons within a block of pre-paid lessons for a period of 12 weeks or more, then any remaining lessons will be forfeited.

I cannot be held responsible for any mechanical or electrical failure which may cause the prevention or termination of a lesson or driving test. If the weather is too severe to take a lesson, I can re-arrange your lesson. The decision will be made considering your ability and any advice given by motoring organisations. If you decide to cancel at short notice due to weather and the conditions are suitable to drive, the lesson will be chargeable

Lessons
Your driving lesson will be on a one to one basis. If you would like a parent or friend to come along on your lesson, then that can be arranged. You will always receive the full lesson time you have paid for. I will be happy to start and finish your lesson from different locations, providing these are agreed at least one week in advance, and that both are within the usual area of my work.

Penalties
Whenever you are driving in the school vehicle, you will be under close supervision. However, Samia's Driving School cannot be held responsible for any infringement of the law. Any fines that are incurred will be the responsibility of the driver.

Practical tests
I will make every effort to help you reach a good standard of driving that will enable you to pass your driving test, and you must try to maintain regular lessons leading up to your test otherwise your test date might have to be moved back to give you more time to prepare. The only way to pass the driving test is to be properly prepared. In the interest of road safety, I reserve the right to withdraw the use of my car for tests without prior notice, should you prove to be unsafe and not up to test standard.

The £62.00 fee made when booking the practical driving test will be paid directly to the DVSA.

Damage to the School Car
During lessons, I will make every effort to avoid damage to the car. However, if I consider that you were driving in a dangerous or unpredictable way during a lesson and actual damage is caused despite best efforts made, you will be expected to pay half towards repairs (up to the level of excess on the instructor's insurance policy). This will be discussed at the time of the damage. In addition, during driving tests, the examiner will not prevent you, the candidate from hitting the kerb or causing other similar minor damage to the car. Therefore, all damage caused by you whilst on test will be charged to you (up to the level of excess on the instructor's insurance policy).

Punctuality
I will contact you if I am going to be later than 10 minutes for your driving lesson. The time lost will be added to the end of the lesson if possible, or added to another lesson at a later date. If you are late for your lesson, then that time will be lost.
Communications: To ensure that communication channels are in place, please ensure that I am aware of your current mobile and landline numbers.

Holidays and Availability
I will give you notice of holidays or days where I am unavailable. Please ensure that you do likewise. Please be sure to book your first lesson after your holiday or break in tuition, to retain your place on the diary and to maintain progress.

Code of Practice
I will abide by the Voluntary Code of Practice which has been agreed between DVSA and the main bodies representing Approved Driving Instructors.

Complaints
Complaints by clients should be made in the first instance to Samia's Driving School. Failing agreement or settlement of a dispute, reference may be made to DVSA's Registrar of Approved Driving Instructors who will consider the matter and advise accordingly. Should the Registrar not be able to settle the dispute he or she may set up a panel, with representatives from the ADI industry, to consider the matter further or advise that the matter should be referred to the courts or other statutory body to be determined.

Driving Instructor Training - Terms & Conditions

Pre-Conditions of Driving Instructor Training and Acceptance From DVSA.

When applying to become a driving instructor, you must fulfil the following legal requirements:

  • Obtain and complete a criminal record disclosure.
  • Hold a full UK, unrestricted car driving licence.
  • Have held your full UK driving licence for over 3 years, prior to entering the Register.
  • Not have been disqualified (banned) from driving in the last 4 years, prior to being entered on the register.
  • Be a 'fit and proper' person to have your name entered on the Register. all convictions, motoring and non-motoring still in force will be taken into account when assessing your suitability to be entered on the Register. This includes fixed penalty offences such as speeding.

*If any of the information set out above is false or ceases at any time to be correct, or if any other information You have provided Us with, which We have relied on in deciding to enter into this Agreement is incorrect or ceases, at any time, to be correct, we may terminate this Agreement

*We will use any reasonable efforts to ensure you can complete any in-car training You have booked.

*You will be responsible for arranging Your Part 1, Part 2 and/or Part 3 tests with the DVSA and You must pay the fees for each of these tests directly to the DVSA. The DVSA require You to pass both Your Part 2 and 3 tests within two (2) years of passing your Part 1 test. You are responsible for arranging your Part 2 and Part 3 in-car driving tuition in a timely manner, to ensure that you meet this requirement (or any version of it). We may provide You with guidance as to whether and when, in Our opinion, You are prepared to take Your Part 2 and/or Part 3 test. However, as with the Part 1 test, if we advise that you are prepared for Your Part 2 and/or Part3 test, We do not give any guarantee that You will successfully pass.

*You are responsible to meet any DVSA requirement(s) with regards to attendance at and participation in, any tests including, but not limited to, arranging and being accompanied by a pupil during Your Part 3 test

*Should we provide you with a vehicle for use in Your Part 2 and/or Part 3 test, You will use the vehicle for this purpose only, and You will be responsible for meeting any costs We incur as a result of any damage sustained to the vehicle or any accident involving the vehicle whilst in Your custody, which is not covered by Our insurance policy. We reserve the right to refuse to provide you with or procure a vehicle for use in Your Part 2 test, should Your driving, in either Our or Your Trainer's opinion, be unsafe. In addition to this, we reserve the right to refuse to provide you with or procure a vehicle for use in Your Part 3 test, where, in Our or Your Trainer's opinion, You have not reached the minimum standard of competence, and cannot safely and responsibly manage or control the driving of a pupil.

*Should You need to re-sit Your Part 2 and/or Part 3 test or sit a test which has been rescheduled due to, You not meeting the standards as stated above, it is Your responsibility to pay all relevant fees to the DVSA, and for arranging to re-sit or reschedule the test with the DVSA.

*You will normally be provided with a vehicle to sit or re-sit Your Part 2 or Part 3 test, upon Your request, and unless You use part of Your in-car tuition allowance for any test (at a cost of 2 hours per test) We will be entitled to charge You for the use of any vehicle at Our then-current rates.

*We may be able to provide You with additional training, beyond that included within each individual part. This is available upon Your request, and You will be required to pay us for any additional training at Our then-current rate(s), which we can provide you with upon Your request. Any additional training must be paid for by You in advance to Us, at the then-current rates.

*Although you are not obliged to share the outcomes of each test, we would appreciate if You could please advise Us as soon as possible, whether you have passed or failed. It would also be appreciated if you could please provide Us with a copy of Your test results, as these will allow Us to identify any areas for future development to help You with Your training.

*You will be required to pay an initial £600 deposit to Samia's Driving School for any methods of payment.

*We are not liable for any death, loss or injury sustained by You, during or after your training, unless such incident is due to Our negligence or breach of Your Agreement.

*We may assign, hold in trust, licence or sub-contract all or any part of Our rights or obligations under the Agreement. As such, we may provide some of Our Services through third-party Driving Instructor Trainers.

*Any Agreement is personal to You, and as such, You are not permitted to assign; hold on trust; licence; sub-contract or resell any or all of Your rights or obligations under the Agreement without Our prior written consent.

*No one else shall be able or permitted to enforce any of the terms of the Agreement.

*The Agreement may not be edited or varied unless that variation is in writing and signed by both parties (Us and You).

Refund Policy
If you purchase our product, either the Full Course or TCIT Part 3, you are entering into an agreement with Samias Driving School for the instructor training package (course materials and online communications). You will have a separate agreement with your trainer, in terms of your face to face training sessions. If you have already received the training materials and wish to withdraw from the course, you have 14 days from the day you receive the materials, to return these to us unopened and unused. In which case, you will receive a full refund from us. You must email us at instructor.training@samiasdrivingschool.co.uk to inform us that you wish to return the materials and we will give you the postal address. You must retain a proof of postage and bear the cost of postage yourself.

By taking driving instructor training with Samia's Driving School it is accepted that you have read and agree to these terms and conditions.
